After a person has been arrested, they must be booked in a jail. The booking process alone can be as fast as an hour in a local jail or as long as 24 hours at a county jail. Contacting Allstate Bail Bonds as soon as possible after an arrest will reduce the amount of time your friend or loved one will spend in jail. There are five different types of Bail that can be posted to secure the release of your loved one. Allstate Bail Bonds will be happy to review all of your options and help you determine which option is best for you. The options include:
Bail Bond – the courts or jail will accept a Bail Bond in lieu of cash or other property to secure the release of a person arrested for a crime. The rates for Bail Bonds are set by law, usually 10% of the total required bail. No one can charge less for a Bail Bond than Allstate Bail Bonds. If a company offers a lower rate they are likely practicing ‘Bait and Switch’ and breaking the law. Once you contact us we will ask you some questions about the person arrested, such as what they have been charged with, which facility or jail they are being held in and how long they have been detained. We will then ask questions to determine financial risks such as, is the person employed, where they live and how long they have been in their residence, etc. After we have gathered the required information and signatures on the Bail Documents we can Post Bail and get your loved one released
Property Bond – The courts have allowed releases from jail by posting a property bond. The real estate used to secure the release generally needs to equity of 150% of the required bail amount. Given the volatile real estate market, the time required for the process of appraisal, title search and escrow, and all their attendant fees Property Bonds are not used often and never for an individual who wants to be released quickly from jail.
Cash Bail – The courts will accept cash for the full amount of bail. The money can in the form of cash or a cashier’s check. Individual courts can vary on acceptable forms of payment. The courts will often need to verify the source of large cash bail sums to ensure the funds come from a legal source.
Own Recognizance – Defendants or accused persons can be released on their Own Recognizance or O.R. This is usually done for lesser crimes. Only the judge can make the determination to release someone on their Own Recognizance.
Citation Release – This is given to a person by the police officer when they are cited. Citation releases are most common in traffic tickets and include instructions for the court of jurisdiction and appearance dates. The Process of Releasing a person from jail and the time required will vary depending on which facility they are being detained. It is merely the reverse of the booking process. They will need to be escorted from their holding cell, sign for and collect any personal property, and sign papers explaining their rights and obligations according to the terms of the bail.
